This Agreement ("Agreement" or "Terms" or "Terms and Conditions") describes the terms and conditions governing the use of your Account, e-Wallet and Cards at Spotcash.
The Virtual Credit Card and Physical Credit Card (both referred to as "Card") are issued by the Regulated Provider and the electronic money on the Account accessed by the Card is issued by the Regulated Provider.
By purchasing, accepting or using a Card, you agree to be bound by these Terms and Conditions. The current version can always be found at www.spotcash.in.
You do not need to log on to your Account to view these Terms and Conditions.
As used in this Agreement, the following terms have the following meanings. The singular shall include the plural, and vice versa.
The Services described in this Agreement are only available to individuals who have been approved in advance by us. We may, in our sole discretion, at any time, refuse to allow you to perform a credit card transaction, fund or use any of these Services.
Your Account is set up by completing an application process with us. It consists of one e-Wallet and any other Spotcash Products and Services purchased by or provided to you. You access your Account using a unique User ID and password.
When you sign up for an Account, we will provide one e-Wallet to you. To use your e-Wallet, you must sign on to your Account. You can:
You must have a verified Account before you can access our services at Spotcash.
If you have a valid credit card and account number, you can request us to determine if you are eligible to use the credit card service, based on Personal Information and Account history on file.
You may have requested Physical Card(s) at the time you obtained your Account, or at any time thereafter. Physical Card(s) hold their own e-money balance.
Your Physical Card can be used at any merchant worldwide that accepts the relevant Card Organisation. You can use your Physical Card by: Contactless, inserting into a POS terminal, swiping the magnetic stripe, or withdrawing at ATMs.
Your Card information is important and must be kept confidential. Under this Agreement, you agree to:
Each time a Card is used at Spotcash, the amount of the transaction will be immediately deducted from your available balance. All applicable Fees as specified in Section IX will also be deducted.
You are not allowed to exceed the balance on any Card by any individual transaction or series of transactions. Any deficit shall be treated as a debt due to us and payable forthwith.
Note: You shall not be allowed to convert crypto currencies in your e-Wallet for use on your Card. Such conversions will be segregated in your e-Wallet and can only be transferred or withdrawn through the e-Wallet.
Your Spotcash account validity is lifetime. We will notify you about your Spotcash account once a year for user activity. You will be required to activate your account annually according to instructions provided via email to your Account Message Centre.
Should you wish to cancel your Spotcash account, you may do so on written notice to Spotcash. Upon receipt, you may withdraw any remaining funds by:
We reserve the right to block access or cancel your account if: (1) you load funds from a source you do not have legal right to transfer; (2) you violate the Terms of this Agreement; or (3) directed by order of a court of competent jurisdiction.
All Fees are applied in INR. Spotcash may, in our sole discretion, modify these Fees with two (2) months' prior notice.

Transaction Limits:
Each time that you use a Card, the transaction will be electronically authorised to ensure that sufficient funds are available.
When you make a purchase, we receive an authorisation from the bank which reduces available funds by the authorised amount. This pending authorisation remains until: (1) a settlement transaction is received from the bank, generally within 7 days; or (2) we receive an authorisation release from bank or gateway owner.
If you identify a charge significantly different from what was agreed at the time of transaction, contact Spotcash Customer Service immediately. We will treat this as a dispute per Section XIV.
A statement of balance and activity on all Cards is available to you in electronic format for viewing online anytime on your Spotcash Account. You may review all transactions and download your wallet balances and transaction history.
You may also call Spotcash's Account Holder Services Centre on the number shown on our website to obtain information on any of your Cards.
We accept no liability for failing to complete any transaction for which you have not loaded sufficient funds in your Account or onto your wallet. If a transaction is denied due to insufficient funds, you may visit www.spotcash.in and transfer additional funds.
Neither Spotcash nor our Regulated Provider will have any liability for the failure of any transaction to accept your Card.
If you become aware of an unauthorised transaction, notify your bank immediately and within 30 days of the date of the transaction. We reserve the right to refuse a refund if you fail to notify us within 13 months.
If an alleged fraudulent transaction is found, we will promptly investigate. Unless we suspect fraud on your part, we will immediately refund the claimed amount. You agree to cooperate with police or governmental enforcement bodies if requested.
We will promptly investigate and immediately correct any error. We will refund any incorrectly executed transaction unless caused by breach of this Agreement, gross negligence, or suspected fraudulent activity.
You may claim a refund for an authorised transaction if: (A) your authorisation did not specify the exact amount; or (B) the amount exceeded what you could reasonably have expected. Such refund must be requested within 2 days.
Spotcash will try to resolve any complaint as soon as possible. We will respond within one (1) Business Day after receipt of your complaint to acknowledge receipt and inform you of the expected resolution timeline.
In all cases, we will notify you of the final resolution within two (2) weeks of receiving your complaint.
The circumstances under which we will disclose information about you are fully described in the Privacy Policy on Spotcash's website. Spotcash may provide information about you:
Your Personal Information may be shared with fraud prevention or credit reference agencies to: verify identity, trace debtors, prevent fraud/money laundering, manage your Card(s), and perform statistical analysis.
You grant us the right to keep a record of this information for a period of five (5) years, unless modified by the relevant authority.
With at minimum two (2) months' prior notice, we may change the Terms of this Agreement or any policies, including changing or increasing Fees. Any changes will be effective two months after posting on www.spotcash.in and email notification to you.
By entering into this Agreement and using your Card(s), you agree to receive notice of changes electronically rather than on paper.
Spotcash is not your agent, fiduciary, trustee or other representative. We do not give up our rights by delaying or failing to exercise them at any time.
Your Card(s) shall not be used as payment for an illegal transaction or for any other illegal purpose. Should we suspect illegal use, we have the right to cancel your Card(s) immediately and report to appropriate governmental authorities.
We will not be liable for failure to perform any obligations due to events beyond our control, including acts of God, war, equipment failures, bank failures, strikes, fire, flood, or other casualty.
